These Terms and Conditions govern your use of aluseal.ca and purchases made through the website.

By accessing the website, creating an account or submitting an order, you agree to these Terms and Conditions. If you do not agree with these Terms, please do not use the website or place an order.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to place an order through the website.

If you place an order on behalf of a company or another organization, you confirm that you have authority to act on its behalf and bind it to these Terms.

2. Product Information

Aluseal makes reasonable efforts to provide accurate product descriptions, dimensions, colours, specifications, images, availability and pricing.

However:

• Product colours may appear differently depending on the customer’s screen, lighting and manufacturing batch.
• Images may include accessories or materials that are not included with the product.
• Dimensions, weights, coverage and other measurements may be approximate unless expressly identified as exact.
• Packaging, labelling and product appearance may be changed by the manufacturer without notice.

Customers are responsible for confirming that a product is suitable for their intended application, project requirements and measurements before ordering or installation.

Nothing in this section limits a customer’s rights when a product is defective, incorrectly supplied or materially different from its description.

3. Prices and Taxes

All prices displayed on Aluseal.ca are in Canadian dollars unless otherwise stated.

Prices do not include HST, delivery charges or other applicable fees unless expressly stated. Applicable taxes and charges will be shown before the order is completed.

Prices, promotions and discounts may change without notice. A price change will not affect an order that Aluseal Building Products Inc. has already accepted, except in the case of a genuine and material pricing error.

Promotional offers may be subject to additional conditions, expiry dates, product exclusions and quantity limitations. Unless otherwise stated, promotional offers cannot be combined.

4. Placing and Accepting Orders

Submitting an order through Aluseal.ca constitutes an offer to purchase the products listed in the order.

Before submitting an order, customers are responsible for reviewing:

• Selected products and quantities.
• Product options, colours and dimensions.
• Billing and delivery information.
• Delivery or pickup method.
• Prices, taxes, delivery charges and the total amount payable.

Customers must correct any errors before submitting the order.

An automatic message acknowledging receipt of an order does not necessarily mean that the order has been accepted. An order is accepted when Aluseal Building Products Inc. sends an order confirmation, confirms that the order is ready for pickup or schedules the order for delivery.

Aluseal Building Products Inc. may contact the customer to verify order information before accepting or processing an order.

5. Payment

Payment must be made using one of the payment methods displayed at checkout or otherwise accepted by Aluseal Building Products Inc..

Customers confirm that they are authorized to use the selected payment method and that all billing information provided is accurate.

Submitting a payment authorization does not guarantee that an order will be accepted. If payment has been collected for an order that Aluseal Building Products Inc. cannot accept or fulfil, the collected amount will be refunded to the original payment method.

Payment must be completed before pickup or delivery unless Aluseal Building Products Inc. has provided separate written payment or credit terms.

6. Product Availability and Order Errors

Product availability displayed on the website is subject to change and is not guaranteed until the order is accepted.

Aluseal Building Products Inc. may refuse or cancel an order because of:

• Insufficient inventory.
• Incorrect product information or a genuine pricing error.
• Inability to deliver to the requested location.
• Incomplete or inaccurate customer information.
• Suspected fraud or unauthorized payment.
• A supplier or manufacturer being unable to fulfil a Special Order.
• Another reasonable circumstance preventing the order from being completed.

When appropriate, Aluseal Building Products Inc. may contact the customer and offer the choice of approving a corrected price, selecting an alternative product or cancelling the affected product.

If Aluseal Building Products Inc. cancels an order after collecting payment, the amount paid for the cancelled product and any applicable taxes or charges will be refunded to the original payment method.

7. Customer Cancellations

Customers may request an order cancellation by contacting Aluseal Building Products Inc. as soon as possible.

Cancellation requests are not guaranteed once an order has been accepted, prepared, transferred to a delivery vehicle or made ready for pickup. If an order can no longer be cancelled, the Return and Refund Policy will apply.

Products marked as “Special Order” may not be cancelled after Aluseal Building Products Inc. has ordered the product from the supplier or started preparing it specifically for the customer, except where cancellation is required by applicable law.

Products marked as “Final Sale” cannot be cancelled after the order has been accepted, except where required by applicable law.

8. Customer Pickup

Customers selecting pickup must wait until Aluseal Building Products Inc. confirms that the order is ready.

Customers should inspect the quantity and visible condition of products at the time of pickup whenever reasonably possible.

Responsibility for the handling, transportation and storage of an order passes to the customer after the order has been picked up. This does not remove any rights relating to defects or damage that existed before pickup.

9. Delivery

Delivery availability, schedules, service areas and charges are explained in Aluseal’s Building Products Inc. Delivery Policy, which forms part of these Terms and Conditions.

Customers are responsible for providing a complete and accurate delivery address, contact information and any relevant access instructions.

Delivery dates and times are estimates unless Aluseal expressly confirms otherwise. Deliveries may be affected by weather, road conditions, product availability and circumstances outside Aluseal’s Building Products Inc. reasonable control.

Customers should inspect the quantity and visible condition of delivered products as soon as reasonably possible and notify Aluseal promptly of missing, incorrect or visibly damaged products.

Failure to report visible damage immediately does not remove any rights that cannot legally be waived.

10. Returns and Refunds

Returns and refunds are governed by Aluseal’s Return and Refund Policy, which forms part of these Terms and Conditions.

Eligible non-defective products may be returned within the applicable 14-day period when all return conditions are satisfied.

Except where required by applicable law:

• Products marked as “Special Order” are non-returnable.
• Products marked as “Final Sale” are non-returnable.
• Products damaged after pickup or completed delivery due to customer handling, installation, alteration, misuse, improper storage or customer-arranged transportation are non-returnable.
• Original delivery charges are non-refundable when a non-defective product is returned.

Approved refunds are issued to the original payment method.

Nothing in these Terms or the Return and Refund Policy limits legal rights concerning defective, incorrectly supplied, damaged or misrepresented products.

11. Third-Party Products and Manufacturer Warranties

Aluseal Building Products Inc. sells and distributes products manufactured by third parties. Unless expressly stated otherwise, Aluseal Building Products Inc. is the retailer or distributor and is not the manufacturer.

Some products may be covered by a manufacturer’s warranty. Manufacturer warranty claims are subject to the applicable manufacturer’s conditions, exclusions, procedures and warranty period.

Aluseal Building Products Inc. may reasonably assist customers with manufacturer warranty information, but Aluseal Building Products Inc. does not control a manufacturer’s assessment or decision.

Nothing in this section excludes any condition, warranty or remedy that applies under Ontario’s Consumer Protection Act, Sale of Goods Act or other applicable law.

12. Installation and Product Use

Products must be handled, stored, prepared and installed according to:

• Manufacturer instructions.
• Product technical data sheets.
• Applicable building codes and safety requirements.
• Accepted professional practices.

Website descriptions, product information and general assistance provided by Aluseal Building Products Inc. are not a substitute for advice from a qualified contractor, engineer, architect or other licensed professional.

Customers are responsible for verifying measurements, quantities, colour compatibility and product suitability before cutting, altering or installing materials.

To the maximum extent permitted by law, Aluseal Building Products Inc. is not responsible for damage or loss caused by improper transportation, storage, handling, preparation, installation, alteration, maintenance or use.

13. Website Accounts

Customers are responsible for:

• Providing accurate and current account information.
• Maintaining the confidentiality of their password.
• Restricting unauthorized access to their account.
• Notifying Aluseal of suspected unauthorized account activity.

Aluseal Building Products Inc. may suspend or close an account that is used fraudulently, unlawfully or in violation of these Terms.

14. Reviews and Customer Submissions

Customers may be permitted to submit reviews, comments, photographs or other content.

Submitted content must:

• Be truthful and based on genuine experience.
• Not contain unlawful, abusive, misleading or discriminatory material.
• Not violate another person’s privacy or intellectual-property rights.
• Not contain advertising, spam, malicious software or confidential information.

By submitting content, the customer grants Aluseal Building Products Inc. a non-exclusive, royalty-free right to display, reproduce and use that content in connection with the website and Aluseal’s Building Products Inc. business.

Aluseal Building Products Inc. may review, decline, edit or remove submitted content where reasonably necessary, but is not obligated to publish every submission.

15. Acceptable Website Use

The website may only be used for lawful purposes.

Users must not:

• Attempt to gain unauthorized access to the website or another customer’s account.
• Interfere with the website’s operation or security.
• Introduce viruses, malicious code or harmful technology.
• Use automated tools to scrape or copy website content without permission.
• Use the website for fraudulent or misleading activity.
• Copy or commercially exploit website content without authorization.

16. Intellectual Property

The website and its content—including text, photographs, graphics, logos, product organization and website design—are owned by or licensed to Aluseal Building Products Inc. or their respective rights holders.

Brand names, product names and trademarks belonging to manufacturers remain the property of their respective owners.

Website content may not be copied, reproduced, modified, distributed or used commercially without prior written permission, except as allowed by law.

17. Third-Party Websites

Aluseal.ca may contain links to manufacturer websites, social-media platforms or other third-party services.

These websites are operated independently. Aluseal Building Products Inc. is not responsible for their content, availability, security or privacy practices. Visiting a third-party website is subject to that website’s own terms and policies.

18. Limitation of Liability

Aluseal Building Products Inc. makes reasonable efforts to maintain an accurate and secure website but cannot guarantee that the website will always be uninterrupted, error-free or free from harmful components.

To the maximum extent permitted by applicable law, Aluseal Building Products Inc. will not be responsible for indirect, incidental or consequential losses arising from:

• Website interruption or unavailability.
• Customer misuse or improper installation of a product.
• Customer-provided information that is inaccurate or incomplete.
• Delays or events outside Aluseal’s reasonable control.
• Third-party websites, manufacturers or service providers.

Where liability cannot legally be excluded, Aluseal’s Building Products Inc. liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability or customer rights that cannot legally be excluded or restricted.

19. Events Outside Our Control

Aluseal Building Products Inc. is not responsible for a delay or failure caused by circumstances outside its reasonable control, including severe weather, road closures, fire, flood, labour disruption, transportation interruption, supplier failure, government action or interruption of utilities or communication systems.

Aluseal Building Products Inc. will make reasonable efforts to notify affected customers and complete or reschedule the order.

This section does not prevent a customer from exercising a cancellation or refund right available under applicable law.

20. Privacy and Electronic Communications

Personal information is collected, used and protected according to Aluseal’s Building Products Inc. Privacy Policy.

By placing an order, customers agree to receive transactional communications relating to that order, including confirmations, payment notices, pickup information and delivery updates.

Promotional emails will only be sent where permitted by law, and customers may unsubscribe using the instructions provided in those communications.

21. Consumer Rights

These Terms are intended to operate together with applicable Canadian and Ontario laws.

Nothing in these Terms limits or removes any consumer right, condition, warranty or remedy that cannot legally be waived.

If any part of these Terms conflicts with a mandatory legal requirement, the legal requirement will apply.

22. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to any mandatory consumer right concerning jurisdiction, disputes relating to these Terms or purchases from Aluseal Building Products Inc. will be handled by the courts located in Ontario.

23. Changes to These Terms

Aluseal Building Products Inc. may update these Terms and Conditions from time to time.

The revised Terms will be posted on this page with an updated effective date. Changes will apply to website use after they are published.

The version in effect when an order is accepted will continue to govern that order unless a change is required by law or agreed to by the customer.

24. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.
